Please read these Site Terms carefully as they govern your use of our Site and your purchase of any products sold through our Site. You acknowledge and agree that by visiting our Site and placing an order for products through our Site (whether during this visit to our Site or in the future), you agree to be bound by these Site Terms without reservation. We reserve the right to change these Site Terms at any time by updating them on this page. These Site Terms were last updated on 22 August 2013. Our use of any personal data you provide to us through our Site is governed by our Privacy Policy and Cookie Policy, which are available on the Site.<\/p>\n\n\n\n

1. HOW TO PLACE AN ORDER AND HOW IT IS PROCESSED<\/h5>\n\n\n\n

1.1. Once you have selected your order from our Menu, you can submit your order and proceed to payment of the total order amount by clicking on “continue”, “place my order” or a similar button. Please note that it is important to check all the information you enter and correct any errors before clicking this button and finally accepting your order, as once you have clicked this button, errors cannot be corrected.<\/p>\n\n\n\n

1.2. All orders must be paid in full before being submitted to Five Guys. Payment for any order must be made by credit or debit card as detailed on our Site.<\/p>\n\n\n\n

1.3. The prices of our products are those indicated on our Site inclusive of VAT. Prices may be changed by Five Guys without prior notice. You will be informed of the price of our products before accepting your order.<\/p>\n\n\n\n

1.4. Please note that delays may occur from time to time in processing payments and your orders; sometimes it may take up to sixty (60) days for payments to be deducted from your bank account or credit card.<\/p>\n\n\n\n

1.5. Upon receipt of your order and payment confirmation, Five Guys will begin processing your order and we will send you an email confirming receipt and processing of your order.<\/p>\n\n\n\n

1.6. If the payment you make is not authorized, you will be redirected to the previous page of our Site and we will not be obliged to deliver the products ordered to you.<\/p>\n\n\n\n

1.7. Please note that once you have placed your order and your payment has been authorized, you will not be able to cancel your order nor will you be entitled to a refund. The right of withdrawal does not apply to perishable goods.<\/p>\n\n\n\n

Five Guys and all group companies, and any of their officers, directors, employees, shareholders or agents, exclude all liability for any amount or kind of loss or damage (including negligence that may result to you or a third party) including, but not limited to, any direct, indirect, punitive or special loss or damage, or any loss of income, profits (whether direct or indirect in nature), goodwill, data, contracts, or loss or damage due to or in any way connected with business interruption, loss of opportunity, loss of anticipated savings, wasted management or office time, whether in tort (including negligence), contract or otherwise (even if foreseeable) in connection with our services, this Website or in connection with the use or results of the use of this Website, any websites linked to it or the materials on this Website.<\/p>\n\n\n\n

7.2. Nothing in these Website Terms excludes or limits our liability for death or personal injury resulting from Five Guys UK’s negligence, nor Five Guys UK’s liability for fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. Except for any liability set out in paragraph 7.2 above, Five Guys’ total liability to you in relation to your use of this Website and the services we provide, including (but not limited to) liability for breach of these Website Terms and\/or damage (including, but not limited to, negligence), is limited to an amount equal to twice the value of your order or \u00a3100, whichever is the lower.<\/p>\n\n\n\n

12. FORCE MAJEURE<\/h5>\n\n\n\n

A Force Majeure Event means any event beyond our control and includes, in particular, without limitation, the following: (a) strikes and industrial disputes; (b) civil unrest, riots, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or not) or threats or preparations for war; (c) fires, explosions, storms, floods, earthquakes, epidemics or other natural disasters; (d) the impossibility of using transport infrastructure (railways, ships, aircraft or other means of public or private transport); (e) the impossibility of using public or private telecommunications networks; and (f) laws, decrees, legislation, regulations or restrictions imposed by any competent public authority.<\/p>\n\n\n\n

12.3. We may suspend our services or the sale of our products for the duration of the force majeure event. We will implement the necessary measures to ensure the continuation of our services and the sale of our products despite the duration of this force majeure event.<\/p>\n\n\n\n

13. ENTIRETY<\/h5>\n\n\n\n

These Site Terms and any ancillary documents expressly referred to herein constitute the entire terms and conditions applicable to the use of our Site and your orders for our products and prevail over all other documents and\/or correspondence exchanged between Five Guys and you.<\/p>\n<\/div>\n\n\n\n
